WHAT WE DO
Once Guardian & Conservator Services, LLC (GCS) has gone through the legal proceedings and been named as permanent guardian or emergency guardian our office assumes the following roles and responsibilities:
- Preliminary functional assessment of the ward's ADLs (Activities of Daily Living) and IADLs (Instrumental Activities of Daily Living)
- Determine and monitor living environment
- Consent to and monitor medical treatment
- Consent to and monitor non-medical services such as private in-residence care provider
- Release of confidential information
- Make end-of-life decisions
- Maximize independence in least restrictive manner
- Report to the court about the guardianship status at least annually
GCS will advocate on behalf of the ward for:
- Housing and living arrangements
- Employment and training
- Entitlements and benefits
- Basic civil and property rights
- Religious rights
- Uncensored communication
- Medical rights
- Parental rights
GCS will act as a surrogate decision-maker by using "substitute judgment"- making decisions that would reflect what the protected person would have decided if he/she were capable of making decisions.
GCS will strive to keep in mind the best interests of the protected person and take the least intrusive, least restrictive, most normalizing course of action possible.
